A. Hotel stays and meeting rooms
1. Scope and contracting party
These General Terms and Conditions apply to the booking and use of hotel rooms, meeting rooms and related services at artHOTEL Magdeburg. They apply to individual, corporate and group reservations, regardless of the number of rooms booked.
The contracting party is artHOTEL Magdeburg GmbH, Breiter Weg 9, 39104 Magdeburg, Germany, telephone +49 391 / 620 780, email info@arthotel-magdeburg.de. Individually agreed terms take precedence over these General Terms and Conditions.
These are artHOTEL Magdeburg’s own contractual terms. These General Terms and Conditions and their special provisions apply to the hotel contract, the purchase of artHOTEL value vouchers and the redemption of ARTClub loyalty vouchers at artHOTEL. Hotel-Spider, Yanovis and KunLeiSys / guestclub.net are used as technical systems. Using these systems does not replace the hotel’s contractual terms with the general terms and conditions of these technical providers.
2. Formation of the contract and booked services
The contract is formed when the hotel accepts the order by issuing a reservation confirmation. The accepted offer and the reservation confirmation determine the services booked.
Anyone booking in their own name for other guests is responsible for the contractual obligations arising from that booking. Where a booking is made as a representative, the identity of the contracting party and the representation are governed by statutory provisions. Rooms may only be used by guests registered at the hotel.
The hotel provides the promised services. The customer pays the agreed prices for these services. This also applies to additional services ordered and agreed expenses incurred with third parties.
3. Prices, changes and pricing errors
The agreed prices include service and the applicable statutory VAT. Whether breakfast is included is stated in the offer or the reservation confirmation. Separately charged services are shown with their prices.
The hotel reserves the right to adjust prices for accommodation, services and extras by up to 5%. This applies exclusively to new bookings and services that have not yet been booked or ordered. Guests will not be notified separately of these price changes. The price displayed before booking or ordering is decisive.
For services that have already been booked and confirmed, the confirmed price remains unchanged. This also applies to breakfast, underground parking and other extras.
Incorrect prices may be corrected before a contract is formed. If a pricing error is discovered only after a reservation has been confirmed, the hotel informs the customer without undue delay. Where the statutory requirements are met, the hotel retains its statutory right to avoid the contract on the grounds of mistake. Avoidance must be declared without undue delay. Effective avoidance renders the affected contract void; it does not automatically replace the price with a higher one. The customer’s statutory claims, in particular under section 122 of the German Civil Code (BGB), remain unaffected. This provision also applies to extras that have already been confirmed.
A changed price list or a corrected price entry alone does not entitle the hotel to increase the price of an existing booking unilaterally. The statutory rights of both contracting parties remain unaffected.
Prices for stays from 1 November 2026: breakfast €18.00 per person; children’s breakfast up to age 12 €10.00; underground parking €15.00 per night. The provisions above concerning confirmed prices apply to services already ordered.
4. Payment and invoicing
Payment is made on arrival in accordance with the reservation confirmation. Any different payment deadline agreed remains applicable. Accepted payment methods are cash, Eurocard or Mastercard, Visa, American Express and EC card.
If a third party is to cover the costs, this must be communicated in writing before arrival, including the billing address. Unless otherwise agreed, the contractual customer remains responsible for payment.
Invoices that do not specify a due date must be paid without deduction within seven days of receipt. Statutory provisions apply to late payment. Both parties’ statutory rights concerning evidence and damages remain unaffected.
5. Arrival and departure
Unless otherwise agreed, rooms are available from 3:00 pm on the day of arrival. Arrival after 6:00 pm must be communicated to the hotel in advance. Without such notification, a room not occupied by 6:00 pm is considered not used. Rooms must be vacated by 11:00 am on the day of departure.
6. Cancellation and no-show
The agreed conditions of the booked offer take precedence. Unless otherwise agreed, the following cancellation conditions apply:
- Cancellation is free of charge up to 48 hours before arrival.
- For cancellations within the last 48 hours before arrival, 50% of the total cost of the stay is charged.
- If a room is not used, 80% of the agreed accommodation price is charged.
- For packages and long-term bookings with more than two months between booking confirmation and the stay, cancellation is free of charge up to 14 days before arrival.
Where damages are charged as a lump sum, the customer may prove that no damage or substantially less damage was incurred. Expenses saved and income from letting the room to another guest are taken into account. Cancellation charges and no-show charges are not charged cumulatively for the same unused room.
For hotel stays on specified dates, there is generally no statutory right of withdrawal under section 312g(2), number 9 BGB. An agreed right to cancel is independent of this.
7. Meeting rooms and food brought to events
The conditions above apply to meeting rooms insofar as they are applicable to the event concerned. The scope, period and any special cancellation conditions are determined by the accepted event offer.
If the agreed event end time is exceeded, a surcharge of €100.00 is charged for each additional hour or part thereof.
Bringing food and drinks to events requires a written agreement with the hotel. The customer is responsible for food they bring, in particular its proper procurement and handling. This does not exclude the hotel’s statutory liability.
8. Liability
The hotel’s liability is governed by statutory provisions. This applies in particular to injury to life, body or health and to damage caused intentionally or through gross negligence. The special statutory provisions governing property brought in by hotel guests remain unaffected.
If the customer recognises the risk of unusually high damage, they should inform the hotel promptly so that avoidable damage can be limited.
B. Purchase of online value vouchers
9. Voucher shop and formation of the contract
These special purchase conditions apply to artHOTEL Magdeburg value vouchers purchased in the online voucher shop. The contracting party for the voucher purchase is the hotel named in section 1. Yanovis GmbH provides the technical voucher system.
The value, design, personal dedication and, where applicable, delivery method are selected in the shop. Before purchase, the order and the total amount payable are displayed. The voucher contract is formed upon payment. The voucher may be redeemed after full payment.
10. Payment and delivery
The payment methods actually offered in the relevant checkout process are available. The shop currently displays payment by credit card. Payment by bank transfer is only possible if offered for the order or agreed with the hotel.
The paid voucher is provided as a PDF or sent by email and may be printed. Postal delivery is possible if offered for the order concerned. Any delivery charges and delivery information must be considered before purchase. Statutory rights in the event of non-delivery or late delivery remain unaffected.
11. Redemption, remaining value and safekeeping
The individual voucher code or barcode is used for redemption. The voucher must be kept safe, and loss or suspected misuse must be reported to the hotel. This safekeeping obligation does not exclude statutory rights or liability arising under law.
Purchased value vouchers are used for services at artHOTEL Magdeburg. A stay must be booked separately, subject to availability. If the invoice amount exceeds the voucher value, the difference must be paid. If the invoice is lower, a new voucher is issued for the remaining amount. The value is not paid out in cash, either in full or in part; statutory rights to repayment remain unaffected.
Purchased value vouchers may be redeemed for two years from issue. The specific redemption deadline is stated on the voucher. The purchaser’s mandatory statutory rights remain unaffected.
The paid value is decisive for a value voucher. Prices for services selected later may change; already confirmed bookings and extras are dealt with under section 3. A promised specific service may not be replaced at will solely by reference to a product-change notice.
The minimum stays for ARTClub loyalty vouchers do not automatically apply to purchased value vouchers. Any expressly agreed special redemption conditions must be apparent before purchase.
C. Withdrawal from online value voucher purchases
12. Right and period
Consumers may withdraw from an online contract for a value voucher that is not tied to a specific stay date within 14 days, without giving a reason. The period begins according to the statutory requirements; for the voucher contract provided for here, it generally begins when the contract is formed and proper information on withdrawal has been provided.
The withdrawal must clearly inform the hotel that the voucher purchase is to be cancelled. It may in particular be declared by email or letter to artHOTEL Magdeburg GmbH, Breiter Weg 9, 39104 Magdeburg, Germany, info@arthotel-magdeburg.de, telephone +49 391 / 620 780. Sending the declaration before the withdrawal period expires is sufficient to meet the deadline. The template below may be used; its use is voluntary.
13. Refund and voucher
After receipt of a valid withdrawal, payments received, including the cost of the least expensive standard delivery offered, are refunded within 14 days at the latest. Additional costs resulting from the purchaser’s choice of a more expensive delivery method are excluded. The refund is made using the original payment method unless another cost-free method has been expressly agreed.
A voucher for which the purchase has been validly withdrawn is blocked from further redemption. Simply downloading or printing the value voucher does not remove the right of withdrawal. Statutory requirements apply to services already provided and to any expiry of the right.

D. ARTClub and loyalty vouchers
15. Participation and points system
ARTClub is the joint loyalty programme of artHOTEL Magdeburg and Hotel Stadtfeld Magdeburg. Participation requires signing up or registering for ARTClub. KunLeiSys / guestclub.net is the technical system provided by GASTROpoint GmbH for this purpose.
Loyalty credit is intended for a future stay and depends on the bonus level: Bronze for 0–2 stays with 2%, Silver for 3–10 stays with 3%, and Gold from 11 stays with 4%. Stays during the last five years count towards the bonus level. Ten loyalty points correspond to one euro of voucher credit.
For company reservations, the guest earns loyalty credit based on a fixed amount counted as turnover per night: €50 at artHOTEL and €25 at Hotel Stadtfeld Magdeburg. This basis earns 2% for Bronze, 3% for Silver from 3 stays and 4% for Gold from 11 stays. The amount actually paid by the company is not used in the calculation.
16. Referrals
A referred guest receives 250 loyalty points as a welcome gift. The referring member also receives 250 points after the referred guest has completed their first stay. Processing the data of invited persons requires the necessary consent or other legal basis.
17. Redemption of loyalty vouchers
Loyalty points may be converted in ARTClub into vouchers for a future stay. Loyalty vouchers may be redeemed for direct bookings at artHOTEL Magdeburg and Hotel Stadtfeld Magdeburg. One voucher may be used per room and stay; vouchers may be transferred to another person.
- Loyalty vouchers up to and including €100 require a stay of at least one night.
- Loyalty vouchers over €100 and up to and including €200 require a stay of at least two nights.
Loyalty vouchers cannot be combined with other discount promotions, guest club packages or additional vouchers. Cash payment and redemption when purchasing vouchers are excluded. The voucher must be presented on arrival. Binding special conditions are displayed before the voucher is created.
The two-year redemption period in section 11 applies to purchased value vouchers. It is not applied to loyalty points or loyalty vouchers without a separate determination.
18. Data protection and questions
Information about data processing by the hotel, Yanovis and GASTROpoint is available in the privacy policy and in the respective services. The hotel answers questions about bookings, vouchers or ARTClub using the contact details in section 1.
E. Statutory rights
Individual agreements and mandatory statutory rights take precedence. If an individual provision does not validly become part of the contract or is invalid, the consequences are governed by statutory provisions.
